Shenandoah University and Shenandoah Center for Immersive Learning VR/AR/XR EULA
This End User License Agreement (“Agreement”) is a legal agreement between you (“you” or “User”) and the Shenandoah Center for Immersive Learning (SCiL), a unit of Shenandoah University (SU), (“we,” “our,” or “us”) concerning your use of any virtual reality (VR), augmented reality (AR), or extended reality (XR) software application developed by SCiL, including but not limited to:
- Lewis & Clark VR
- “Lewis & Clark VR,” “Lewis and Clark VR,” “LCVR,” or “App.”
- The Great Experiment
- “The Great Experiment,” “Great Experiment,” “TGE,” or “App.”
- Including both Lite and Premium versions.
By installing, accessing, or using the App, you accept and agree to the terms of this Agreement. If you do not agree, do not install or use the App.
1. License Grant
Subject to your compliance with this Agreement, Shenandoah University and SCiL grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App solely for non-commercial, personal learning or educational use.
Commercial use is strictly prohibited. “Commercial use” includes but is not limited to paid exhibits, resale, or revenue-generating experiences. To inquire about a commercial license, please use the contact information listed below.
“Educational use” means use by individuals, schools, and academic institutions for classroom instruction, research, or educational demonstrations.
2. Intellectual Property
The App and all content within it – including software code, 3D assets and associated textures or materials, narration, designs, text, video, audio, and other visual elements – are the intellectual property of SCiL, SU, or its content providers. All rights are reserved. No part of the App may be copied, modified, or reused for commercial purposes.
3. Restrictions
You agree not to:
- Use the App for any commercial or monetized activity;
- Reverse engineer, decompile, extract or attempt to extract source code;
- Share, sublicense, or distribute the App to third parties;
- Bypass or circumvent security features or licensing restrictions, including attempts thereof.
- Use the App in violation of applicable laws or regulations.
4. Use by Institutions and Minors
If the App is used within a classroom or educational institution, the institution and its instructors are responsible for ensuring proper supervision and compliance with applicable privacy, safety, and accessibility laws.
If the App is used by minors, a parent, guardian, or teacher must provide appropriate supervision. SU and SCiL assume no responsibility for unsupervised use by minors.
5. Health and Safety Disclaimer
Immersive technologies such as VR/AR/XR may cause disorientation, dizziness, motion sickness, or other physical reactions. Users should take appropriate breaks, ensure a safe physical environment, and discontinue use immediately if discomfort occurs. SU and SCiL are not responsible for injury, discomfort, or adverse health effects resulting from the use of the App.
6. Updates
SU and SCiL may update or modify the App at any time. Continued use of the App after updates constitutes acceptance of the modified version.
7. Termination
This Agreement is effective until terminated. This Agreement and your license will automatically terminate if you breach any part of it. Upon termination, you must uninstall and delete all copies of the App.
8. Disclaimer of Warranties
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. SU AND SCIL DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. NOTHING PROVIDED HEREIN SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SU AND SCIL SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OR INABILITY TO USE THE APP.
10. Governing Law and Jurisdiction
This Agreement shall be governed by, and construed in accordance with, the laws of the Commonwealth of Virginia, without regard to its conflict of laws provisions. The Parties agree to exclusive jurisdiction in the courts of Virginia and any actions arising out of, or related to, this Agreement shall be brought in the court of the City of Winchester, Virginia or the Harrisonburg Division of the Western District Federal Court located in Harrisonburg, Virginia.
11. Indemnification
You agree to indemnify, defend, and hold harmless Shenandoah University, SCiL, and their trustees, officers, employees, and agents from any claims, damages, or expenses (including attorney fees) arising from your misuse of the App or violation of this Agreement.
12. Compliance and Export Control
You agree to comply with all applicable U.S. and international laws, including export control and sanctions regulations, when using or distributing the App. You represent that you are not located in a jurisdiction subject to U.S. trade embargoes or designated as a “terrorist supporting” country.
13. Trademarks and Attribution
Nothing in this Agreement grants permission to use the name, logos, trademarks, or visual identity of Shenandoah University or SCiL without express written consent.
